However, such a Trust depends on A being under a duty not to pay any of the money to a person who is not a relative of A0. But can a court enforce that duty? For example, letââ¬â¢s say A chooses to pay out ? 5,000 to X. Is there a meaningful test the court can use to decide if X really is a relative of A0? If not, a key part of Aââ¬â¢s intended duty cannot be enforced; in that case, the intended discretionary Trust cannot exist. And, if that occurs, A will hold the ? 100,000 on Resulting Trust for A0 (or, if A0 has died, for A0ââ¬â¢s estate). We can sum up this point by saying that, for a discretionary Trust to exist, it must pass the ââ¬Å"any given personâ⬠test: a court must be able to tell of any given person (eg X) whether or not that person falls within the class of those to whom A is permitted to distribute the benefit of the right A holds on Trust. 2 That ââ¬Å"any given personâ⬠test is often referred to as the ââ¬Å"given postulantâ⬠test. It seems that neither Sachs LJ nor Megaw LJ wanted to leave the law in such a way as to permit there to be a discretionary Trust in favour of anyone who is a ââ¬Å"good personâ⬠. So each judge added a further certainty requirement. Sachs LJ stated that the class of those to whom A can distribute the benefit of Aââ¬â¢s right must be ââ¬Å"conceptually certainâ⬠: that is, it must be possible to come up with a definition of the class. Practical, evidential problems as to whether X is or is not within that definition can be dealt with by applying the simple rule that X is out of the class until he proves otherwise. So the ââ¬Å"good personâ⬠discretionary Trust will be invalid as there is no clear way of defining that term: it is conceptually uncertain. In contrast, whilst it may be difficult, or even impossible, to tell if X is or is not a relative of A0, that evidential uncertainty will not defeat the discretionary Trust. Megaw LJ added a different requirement, stating that a discretionary Trust can only be valid if there are a ââ¬Å"substantial numberâ⬠of people who are clearly within the class to whom A can distribute the benefit of Aââ¬â¢s right. 8 Again, that requirement can be used to mean that a ââ¬Å"good personâ⬠discretionary Trust is invalid, whereas a ââ¬Å"relativesâ⬠discretionary Trust is not. The extra requirements imposed by Sachs and Megaw LJJ do not assist in fulfilling the purpose of the ââ¬Å"any given personâ⬠test: making sure the court can tell if A distributes the benefit of the right to a person outside the permitted class. It may be that each requirement instead aims to ensure that the discretionary Trust makes some practical 4 5 [1973] Ch 9 at 28-29. Megaw LJââ¬â¢s requirement for a ââ¬Å"substantial numberâ⬠to be within the class is of course quite vague: the point seems to be that, for a iscretionary Trust to make sense, A must have a genuine choice to make as to who will receive the benefit of Aââ¬â¢s right. However, that point is not always correct: for example, the discretion in a discretionary Trust could come from A having a power to decide how much of the benefit of Aââ¬â¢s right a particular individual should receive. 4. 4. 1 Discretionary Trusts Certainty of Objects: Further Tests The ââ¬Å"full listâ⬠test? At one point, it was suggested that a discretionary trust could be valid only if the court could draw up a full list of the people to whom A is permitted to distribute the benefit of a right. On that view, in Example 2, a discretionary trust would arise only if it is possible to draw up a full list of A0ââ¬â¢s relatives. However, in McPhail v Doulton, the House of Lords rejected that view. 9 It was based on the idea that, if A failed in his duty to distribute the benefit of the right, a court would have to step in and decide how to distribute. And, to avoid favouring any one person, the court would have to order equal division of the benefit of the right amongst all members of the class. On that view, a discretionary trust would become, in effect, like the fixed Trust in Example 1b: so a full list would be necessary. In McPhail v Doulton, Lord Wilberforce pointed out that, if A fails in his duty to distribute the benefit of a right, a court does not have to order equal division. 10 After all, such equal division could be one of the worst ways of distributing the benefit of a right: for example, splitting up a fund of ? 100,000 equally among 1,000 people would mean that no one person gains a substantial benefit from the discretionary trust. So, given the other means by which the court can step in to execute a discretionary trust, there is no need to apply the ââ¬Å"full listâ⬠test. 4. 2 The ââ¬Å"administrative workabilityâ⬠test The fact that a court may need to step in and execute a discretionary trust does not mean that a discretionary trust must pass the ââ¬Å"full listâ⬠test. Nonetheless, it may have some impact. For example, if the terms of the attempted discretionary trust mean that there is no sensible plan a court could adopt to execute that supposed trust, then A0ââ¬â¢s attempt to set up a discretionary trust must fail. This point may explain the (rarely relevant) ââ¬Å"administrative workabilityâ⬠test. 11 9 [1971] AC 424. The class of people to whom A could distribute the benefit of its right would thus include over 2 million people. It was found that the councilââ¬â¢s attempt to set up a discretionary Trust failed: the planned Trust was ââ¬Å"administratively unworkableâ⬠. The problem here may be that, if A fails to perform his duty to distribute, the court will have to step in. And is there any sensible way order a court could make to distribute the benefit of Aââ¬â¢s right? We have to bear in mind the need for a court to avoid making the type of contentious political decision which it is ill-suited to make and which may cause resentment. 3 Of course, in most cases, no such problems arise: the ââ¬Å"administrative workabilityâ⬠test rarely prevents an intended discretionary trust from arising. This explanation of the ââ¬Å"administrative workabilityâ⬠test explains why it applies to discretionary trusts but not to attempts to give A a power (as in Example 1a). If A chooses not to exercise a power to distribute the benefit of a right then, as A is under no duty to do so, a court does not need to step in and order some form of distribution. There is thus no risk of a court facing the dilemma that would arise if an administratively unworkable discretionary trust were allowed to be valid. 4. 3 The ââ¬Å"non-capriciousâ⬠test Although the ââ¬Å"administrative workabilityâ⬠test does not apply to powers, that does not mean that powers are free from certainty tests. For example if A has a power to distribute the benefit of a right to all or any of a certain class of people then, as is the case with a discretionary trust, A is under a duty not to distribute outside that class. So, with a power as with a iscretionary trust, the ââ¬Å"any given personâ⬠test applies:14 the power is only valid if a court can tell, should A exercise the power in favour of X, whether or not X is in the permitted class. Sometimes, when accepting a power, A also comes under a duty to act loyally and responsibly when considering whether to exercise that power. In such a case, for example, A (as is the case if A holds a right on a discretionary trust) cannot simply ignore the power: he is under a duty to members of the class of potential recipients to consider periodically whether or not to exercise the power. 5 In these cases, A can be said to have a ââ¬Å"fiduciary powerâ⬠: A is not just under the negative duty not to distribute outside the permitted class; he also has some positive duties in relation to the power. It has been held that A0ââ¬â¢s attempt to set up such a power will fail if the intended power is ââ¬Å"capriciousâ⬠: if there are no sensible criteria A can apply in considering whether and how 12 13 R v District Auditor, ex p West Yorkshire MCC [1986] RVR 24 (noted by Harpum [1986] CLJ 391). However, it does mean that if the supposed power is ââ¬Å"capriciousâ⬠(ie there is no sensible scheme A can come up with) then A0ââ¬â¢s attempt to give A the power must fail. Two points are worth noting about this ââ¬Å"non-capriciousâ⬠test. First, if it is linked to A0ââ¬â¢s attempt to impose a duty on A to act loyally and responsibly when considering whether to exercise a power, it must apply to an attempt to set up a discretionary trust: such a duty is a key part of a discretionary trust. Second, in practice, it is very unlikely that this test will present a problem: people rarely go round setting up bizarre powers that cannot be considered in a sensible way. 4. 4 The ââ¬Å"one personâ⬠test Example 3: A0, an owner of a large number of paintings, dies. In his will, he instructs A (his executor) to allow ââ¬Å"each of my friendsâ⬠to purchase one of those paintings each, at half its market value. In such a case, A0 does not attempt to set up a discretionary Trust: A has no power to choose how to distribute his rights. Rather, each friend of A has a fixed entitlement. A0 is attempting to make a conditional gift: if X satisfies a particular condition (if he is a friend of A0) he has a specific right. Nonetheless, it may seem that there is still a certainty problem: how can A (or the court) tell if X is or is not a friend of A0? However, in re Barlow, the essential facts of which were identical to Example 3,17 Browne-Wilkinson J held that the conditional gift was valid. His Lordship noted that an attempt to set up a discretionary Trust for ââ¬Å"friends of A0â⬠would fail: applying Sachs LJââ¬â¢s test in re Baden (No 2), the term ââ¬Å"friends of A0â⬠is conceptually uncertain. However, a conditional gift should be treated differently: if there was just one person who could clearly show he was, on any reasonable test, a friend of A0, that person is entitled to acquire one of the paintings. 8 The test applied in re Barlow has been criticised. However, it can be defended. If an attempted discretionary Trust (eg in favour of ââ¬Å"friends of A0â⬠) fails a certainty test, then someone who could have benefitted from Aââ¬â¢s power (eg a clear friend of A0) will miss out. But, in any case, that person only had a chance of receiving a benefit; he had no legal guarantee. In contrast, if a conditional gift is found to be invalid when there is a person who definitely stands to benefit from it, that person is deprived of a definite entitlement: a right given to him by A0.

Does the SAT Predict Your College Success and Income SAT / ACT Prep Online Guides and Tips You know itââ¬â¢s important for you to do well on the SATs because better scores will get you into a better college - top colleges want high SAT scores because they are supposed to indicate insight that a particular student is academically strong. Ultimately, a better college education is supposed to help you be more successful in your career. But do your SAT scores really speak to how competent or prepared you are as a potential student? And does a great college really increase your chances of professional success? These are tough, but important, questions - Iââ¬â¢ll address them all here. First, Iââ¬â¢ll talk about what the research says about the relationships between SAT scores, college success, and income. Then, Iââ¬â¢ll present some explanations for why these factors are (or are not) related - it might not be for the reasons you think. So whatââ¬â¢s the real relationship between your SAT scores, college success, and income? Why do these questions even matter? Read on to find out! What Are the Relationships Between SAT Scores, College Success, and Income? In these next sections, I'll talk about the correlations between SAT scores, college success, and future income. If there's a correlation between two factors or variables, that means there's a relationship between them - a positive correlation means that if one variable increases, the other variable will also increase.Causation is something a little different: if there's a causal relationship between two factors, it means one has a direct effect on the other. Just because there's a correlation between two factors doesn't mean there's a causal relationship. Still, though, the correlational relationships I'll discuss are important because they give us clues about how important some predictive factors are - for example, can high SAT scores predict future income? You're about to find out. SAT and College Success If you have high SAT scores, are you likely to get better grades in college? Perhaps unsurprisingly, most research studies find that your SAT scores do predict college success - to an extent. The relationship isn't particularly strong, which means that if you have high SAT scores, you're only slightly more likely to have higher college grades than a student who had lower scores. Research shows a similar relationship between SAT scores and high school grades. Given this relationship, it makes sense that colleges use the SAT as part of their admissions criteria.Schools tend to prefer students with higher SAT scores because they think that, in some small part, these scores could predict how well these students do in school. If schools accept students with higher scores and then these students are successful in college (and beyond), the schools will begin building a positive reputation. Ultimately, higher SAT scores might predict college success, but they'll more likely make you a more competitive college applicant. Keep in mind, though, that highand low scores are totally relative(read more about good and bad SAT scores). SAT and Income If you have high SAT scores, are you likely to earn more money after you graduate from college?There does seem to be a positive relationship between SAT performance and future income - that is, the better a student scores on her SAT, the more likely she is to earn more money later in life. One study found that high scorers not only went on to earn higher incomes, but they were also more likely to earn PhDs, file patents, and get tenure as a professor at a top university. Again, though, this relationship doesn't seem particularly strong. There are many other factors that better predict future income; not all Bachelor degrees pay the same. College Success and Income If you're more successful in college, are you likely to earn more later in life?To answer this question, I'm going to break "college success" down into two different parts: success as attending a top school, and success as earning a high GPA. Top Schools and Income If you end up at a top college, are you likely to earn more money than other college graduates? Students who attend top colleges tend to do pretty well. Top colleges are well-rated in the first place because they have good reputations, high graduation rates, strong undergraduate programs, and strong alumni networks. It would make sense that these factors would be related to greater income post-graduation. And that's exactly what the research shows: graduates of science/math-heavy schools and Ivy League schools tend to earn more than graduates of other colleges. Again, though, these are correlative relationships - you don't necessarily need to graduate from a top college in order to earn a lot of money.Simply getting a college degree is likely to significantly increase your future earnings. GPA and Income If you get better grades in college, are you likely to earn more money than students with lower GPAs? In general, students who do well in college tend to earn more after they graduate. This might depend on your field.Research has found that the difference in income between low-GPA and high-GPA graduates can amount to tens of thousands of dollars in certain careers. You might imagine that if many recent grads are competing for the same awesome job, GPA could end up a very important factor in hiring decisions. So yes, depending on your career path, higher grades are correlated with higher income. How Do All of These Factors Fit Together? It looks like SAT scores, college success, and income are all positively correlated. We can infer that higher SAT scores tendto predict greater college success, and greater college success tends to predict higher incomes later on. These relationships seem to generally fit what we expect.It's important to keep in mind, though, that these are relationships, not rules -just because someone has a perfect SAT score, for example, doesnââ¬â¢t mean that she will end up a millionaire. The real question is WHY these factors are related. Why do we expect high SAT scoresââ â better college ââ â higher income? Iââ¬â¢ll address the possible explanations in the next section. What's the Reason for the Relationships Between SAT Scores, College Success, and Income? What do you think leads to successful outcomes? Thereââ¬â¢s no empirically supported response to this question. Just because we can observe a relationship (correlation) doesnââ¬â¢t mean we can determine whatââ¬â¢s driving it (causation). In this section, though, Iââ¬â¢ll present some of the most plausible explanations for the reason behind these relationships. 1. A Better SAT Score Means You'll Get Into a Better College, and Attending a Better College Means More Opportunities for a Higher Income. This explanation is perhaps the most straightforward.Top colleges consider students more competitive if they have higher SAT scores - we know this to be true (although standardized test scores arenââ¬â¢t the only things that admissions officers consider). The better the school you attend, the more career opportunities are available to you. Here's an example to explain what I mean.Let's say we have two very similar students who attend high school together: same GPA, same list of extracurriculars, same AP courses. Student A studies for two months for the SAT and scores a 1500, whereas student B studies for one week and scores a 20.Although both display the same degree of talent and intellectual ability, Student A gets into an Ivy League college and student B doesn't. Student A has access to more career fairs and recruiters, and can utilize a stronger alumni network before getting her first job, ultimately making more money than Student B. She isn't smarter or more ambitious than her peer - she just has more doors open to her. With student talent (and even the fundamental quality of education) being equal between two people, the opportunities that come with a top college make it easier to earn a higher income after graduation. 2. If You're Naturally Smart, You'll Have High SAT Scores and Probably High Grades. This Means You'll Get Into a Better College and Have More Opportunitiesto Earn a Higher Income. This baby was born smart and happened to score a perfect 1600. This is the College Board's general position on the SAT exam: it's designed to be a totally fair exam that tests aptitude and critical thinking, not general knowledge or even test-taking strategy. Thus, smarter students should earn higher scores without too much practice or prep. Intelligent students will go on to have success in other areas (college applications, job searches) because they're naturally skilled. Some smart people are naturally good test-takers who can earn fantastic scores without much effort. But there are many smart students who donââ¬â¢t necessarily do well on the SAT at first. High school students who don't have much information on the exam, or don't have a strong foundation in core SAT content areas, are at a particular disadvantage (even if they're smart). Test-taking anxiety or unfamiliarity with the exam can significantly bring down the scores intelligent students. Ultimately, while natural smarts might lead to higher scores, many other factors (unrelated to intelligence) can bring them down. 3. If You Come From a Privileged Background, You've Had More Opportunities (Like a Better High School Education), Leading to a Higher SAT Score and Greater Chances for Future Success. Having resources available to you through childhood into adulthood definitely doesnââ¬â¢t make things harder. Students may be fortunate enough to hire a private SAT tutor, for example. Perhaps parents help ensure future success through their own professional connections.Many critics of the SAT endorse this explanation - they feel that for this reason, the SAT puts students from underprivileged backgrounds at a disadvantage, which isnââ¬â¢t fair. Research tends to support this explanation: one study, sardonically naming the SAT the "Student Affluence Test," showed that students from wealthy families tend to out-score students from low-income families by about 400 points. That's a huge margin, one that can make an enormous impact on the sorts of colleges that are within students' reach.While you don't need to come from a wealthy family to do well on the SAT, attend a top college, and earn a high income, it seems that low-income students are fighting an uphill battle. So Which Explanation Is the Right One? What's the right recipe for success on the SAT, in college, and even in your career? Like I mentioned at earlier points in this points, it's really difficult to establish causality when discussing the effects of different factors on future success. It's likely that the "right" explanation is some combination of the ones listed above. High SAT scores + natural smarts + privileged background might be the easiest recipe for future success, but it isn't the only one. There are some factors you won't have any control over - like your family background, or natural test-taking aptitude - but there are things you can do to bring up your SAT scores. And like I mentioned in Explanation #1, SAT scores seem to have the clearest connection to college success and income. I'll address strategies for maxing out your chances for future success in the next section. How Do You Set Yourself Up for Future Success If You're at a Disadvantage? Even an uphill climb can be made easier with the right tools. If you donââ¬â¢t consider yourself a natural test-taker, or if you donââ¬â¢t come from a privileged background, you might be nervous about the SAT. You know it determines (to some extent) what sort of college you can get into, and it tends to predict income. So what can you do if you want to give yourself the best chance possible at being successful? Self Study Work out of a book on your own, take practice tests, and review your wrong answers to improve your scores over a set timeline. The College Board Blue Book is a great place to start if you plan on studying on your own.PrepScholar's blog is also a great free resource for comprehensive, up-to-date content on studying for the SAT. However, this self-study strategy might not be the best option for students who tend to procrastinate or who lack motivation. Take an SAT Class SAT classes are great for an intro to the test, especially if you want to focus on learning strategy. These classes can help you get motivated, but they're not customized to your particular strengths and weaknesses. How Salt Melts Ice and Snow If you live in an area with a cold and icy winter, you have probably experienced salt on sidewalks and roads. This is because salt is used to melt the ice and snow and keep it from refreezing. Salt is also used to make homemade ice cream. In both cases, the salt works by lowering the melting or freezing point of water. The effect is termed freezing point depression. How Freezing Point Depression Works When you add salt to water, you introduce dissolved foreign particles into the water. The freezing point of water becomes lower as more particles are added until the point where the salt stops dissolving. For a solution of table salt (sodium chloride, NaCl) in water, this temperature is -21 C (-6 F) under controlled lab conditions. In the real world, on a real sidewalk, sodium chloride can melt ice only down to about -9 C (15 F). Colligative Properties Freezing point depression is a colligative property of water. A colligative property is one which depends on the number of particles in a substance. All liquid solvents with dissolved particles (solutes) demonstrate colligative properties. Other colligative properties include boiling point elevation, vapor pressure lowering, and osmotic pressure. More Particles Mean More Melting Power Sodium chloride isnt the only salt used for de-icing, nor is it necessarily the best choice. Sodium chloride dissolves into two types of particles: one sodium ion and one chloride ion per sodium chloride molecule. A compound that yields more ions into a water solution would lower the freezing point of water more than salt. For example, calcium chloride (CaCl2) dissolves into three ions (one of calcium and two of chloride) and lowers the freezing point of water more than sodium chloride. Sodium chloride is used for ice cream makers because its inexpensive, readily available, and non-toxic. Yet, sodium chloride (NaCl) is avoided for salting roads and sidewalks because the sodium can accumulate and upset the electrolyte balance in plants and wildlife, plus it can corrode automobiles. Magnesium chloride melts ice more quickly than sodium chloride, but it attracts moisture, which can lead to slick conditions. Selecting a salt to melt ice depends on its cost, availability, environmental impact, toxicity, and reactivity, in addition to its optimal temperature.

The blow that death left me was ten times worse than the separation and finally divorce of my parents. Life was never the same from then on. I took time off school for three months as I slowly sank into depression. However one day I decided that my best friend would not have wanted me to wallow in misery but would have loved to see me excel and go to the college of my dream. His great friendship and his easy-going manner taught me that life is too short not to do the things you love without procrastination and the first on my list is to excel in college and in my career as well and have a great legacy. My Philosophy of Teaching Essay -- Philosophy of Education Teachers Es
Philosophy of Education I believe that teachers have one of the most important and rewarding jobs in this country. Their primary job is to prepare young people for the future. This is why I want to become a teacher. I want to help young people grow and learn, while having fun in the process. In this paper, I am going to share my philosophy and the goals that I hope to achieve and use in my career. I am going to give my beliefs and thoughts on knowledge, the purpose of education, why my chosen field (science) is important and the best methods to use to teach this field, my principles, and the steps and processes I will take in order to become the best teacher I can for my students. I believe that all children have the ability to learn and succeed in school with the possible exception of those that have serious physical or mental handicaps. I donââ¬â¢t think there are such things as bad students, just unmotivated ones, and/or those who are a little bit slower at getting the most out of a given subject. Different students learn by different methods and at different paces. As a teacher I have to be ready for anything. Through personal experience, I have seen that knowledge is both relative and absolute. This couldnââ¬â¢t be more evident than in my field of which is science. The world around us contains several examples of relative and absolute knowledge. An example of absolute knowledge would be our understanding of gravity. The fact that what goes up must come down, unless acted on by an outside force, is constant. An example of relative knowledge would be chemistry. As technology continues to improve we are finding new elements in our world and more information about existing ele... ...g about my field, but I hope to learn as much as I can throughout my career. I feel that it is important to pass on to my students the most recent developments in my field. I really want to become a teacher for several reasons. I love working with young people, especially teenagers. I want to be more than a teacher. I want to be their friend, someone that will always listen to their problems, and help them the best that I can both in and out of the classroom. I want to be an influence on them and leave a positive impact on their lives. Kids are our future, and I want the future to be full of good things. I have experienced these types of teachers myself, along with some very bad ones. I have developed a liking for science from teachers who have set a good example and shown concern. I want to make that difference in my studentââ¬â¢s lives as well.

Your Devices in the Near Future Which input/output devices will you be using in the next one to three years as ââ¬Å"computingâ⬠devices? I really have fallen in love with my Dell desktop computer; so until I need to buy a new one I will just stick to what I know. Plus I have a great computer guy that can fix any problem that may arise and he is always updating and putting protective ware on my pc. I also love my computer because it is simple and I can easily print out things that I need. I love my Dell! Which features/components/form factors will be prominent?Why? I really do love my Dell computer and donââ¬â¢t really want to get anything new unless I had to. If I did have to get a new device I would buy a desktop for sure. I would want one that is easy to use, simple, and to the point. I really dislike all that fancy stuff. I donââ¬â¢t understand it and Iââ¬â¢m comfortable with what I know. There are a few gadgets out there such as the ipad but I really donââ¬â¢t like touch screen stuff. I like touching and the feel of the key board and a mouse. Which features/components/form factors will be important to you? Why?Again the features important to me would just be something simple and Stephanie proof. I am the biggest dork and electronics and I donââ¬â¢t usually get along all that well. I donââ¬â¢t do well with complex devices. I have tried some of them that my friends own but, for me to fork out that kind of cash I would have to go to college just to learn how to operate them. I still have a flip phone and the original iPod. Which applications will you be using on these devices? The only applications that I would be using on my device would be internet explorer, Microsoft office, and to play games.I really donââ¬â¢t use my computer for much more than surfing the web, playing games, and doing my school work. How may these devices change your life in terms of benefits and risks? I donââ¬â¢t think these devices will change my life oth er than the cost of a new device. I donââ¬â¢t have all the money in the world so I just stick to what I know. I am not against the new and advancing technology but I like the good old days. Also the only thing other than the price tag on these devices is my ability to understand how to operate them. I know I can learn but, for right now I am doing just fine with what I have.
